Not getting paid what you’re owed? Here is your game plan.

Unpaid wages can feel like a mountain to climb, but you don’t have to do it alone. If you have be underpaid, your wages are being withheld or your superannuation contributions are outstanding, here is your game plan.

We always recommend contacting the Fair Work Ombudsman (FWO) first—they offer a fantastic free service to help employees understand what they are entitled to. They also convene mediations with your employer, in certain circumstances, to assist you in resolving the dispute before it escalates.

However, if your case is complex, involves multiple claim components (think penalties, shift allowance, on top of wages and overtime), involves a high-income claim, mediation might be tricky. If the FWO is unable to assist, that’s where we come in.

How we charge

For most law firms, underpayment disputes can quickly become uneconomical to run, leaving clients without the representation they need. We offer a tiered payment structure, based on the total value of the claim*, because we don’t believe in running claims just so the lawyers benefit. Our tiers are:

Tier 1

If your total claim is between $0-1,000.00, we are happy to offer you a free consultation to discuss the options for escalating the matter.

Tier 2

If your total claim is between $1,001 and $10,000.00, we can offer you an initial consultation for a flat fee of $150.00, and our work thereafter is charged by reference to an hourly rate but capped at 25% of the total value of the claim.

Tier 3

For claims where the total value is over $10,001.00, we can offer an initial consultation for a flat fee of $300.00, and our work thereafter is charged by reference to an hourly rate but capped at 30% of the total value of the claim – so you pay the lower of those two amounts.
